Terms of Service — Elaiza AI

By using the Elaiza AI app, you are deemed to have accepted the following
Terms of Service. Please read them carefully.
1. Description of the Service
Elaiza AI is an AI-powered digital mental health support tool.
It administers screening tests such as PHQ-9, GAD-7, and WHO-5, offers
personalized work plans, and provides text-based AI sessions.
2. IMPORTANT — Medical Disclaimer
Elaiza AI:
- Is not a substitute for professional medical treatment, therapy, or psychiatric help.
- Is not a licensed psychologist, psychiatrist, or physician.
- Does not diagnose, recommend medication, or write prescriptions.
- Is not intended for use in emergencies.
If you are experiencing a serious mental health problem, have thoughts of
suicide or self-harm, or are in a situation requiring urgent intervention,
please call the numbers below:
- 182 — Suicide Prevention Line (Türkiye, 24/7, free)
- 112 — Emergency Health Services
Or go directly to your nearest emergency room. If you are outside Türkiye,
contact your local emergency number or a suicide-prevention hotline in your
country.
3. AI Interaction
- AI responses are probabilistic and may contain errors.
- Do not blindly follow advice from the AI. Make important decisions together with professional support.
- Conversations are processed by the AI service provider (Google); see the Privacy Policy.
4. User Obligations
You agree not to:
- Use the app if you are under 18 years old
- Use someone else’s identity or create an account on their behalf
- Misuse the service (automated requests, scraping, etc.)
- Direct the AI to produce inappropriate, harassing, or illegal content
- Share content that violates others’ privacy rights
In case of a violation, your account may be closed without prior notice.
5. Subscription & Payment (Auto-Renewable Subscription)
Elaiza offers a free tier and an auto-renewable subscription called
Elaiza Premium.
Subscription content and duration:
- Product name: Elaiza Premium
- Duration options: Monthly and Yearly
- Free trial: A 7-day free trial may be offered on eligible plans.
- Price: The current price is shown at the time of purchase on the in-app subscription screen and on the App Store / Google Play page, in your local currency.
Auto-renewal terms (Apple App Store):
- Payment is charged to your Apple ID account upon confirmation of purchase.
- The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period.
- The renewal fee is charged within 24 hours before the end of the current period.
- You can manage and cancel your subscriptions in your App Store account settings after purchase.
- If a free trial is offered, any unused portion is forfeited when you purchase a subscription to the same publication (if applicable).
Google Play: Subscriptions renew automatically in a similar way
and are managed / cancelled from Google Play → Subscriptions.
Cancellation & refunds:
- Cancellation is done through the relevant store settings and takes effect at the end of the current period; your access continues throughout that period.
- Refunds are subject to Apple’s and Google’s own policies; refund requests are made through the relevant store.
6. Limitation of Liability
Elaiza AI and its developers:
- Do not guarantee that the app will operate uninterrupted or error-free.
- Are not liable for indirect, incidental, or consequential damages arising from use of the app.
- Are not liable for decisions made in reliance on AI responses.
Total liability is limited to the fees paid in the last 12 months (if you have made any payment).
7. Intellectual Property
The design, code, content, and brand of the app belong to Elaiza AI. User
content (journal entries, messages) belongs to you — you grant only a limited
license to provide the service.
8. Account Closure
You can delete your account at any time: Settings → Delete Account.
When deleted, all your personal data is permanently removed within 30 days.
9. Changes
We may update these terms from time to time. You will be notified of
significant changes. Continuing to use the app after a change means you accept
the updated terms.
10. Governing Law & Jurisdiction
These terms are governed by the laws of the Republic of Türkiye. The courts of
İstanbul have jurisdiction over any disputes that may arise.
11. Apple App Store
When the app is obtained through the Apple App Store, these Terms are between
you and Elaiza AI only, not with Apple; Apple is not responsible for the app or
its content. Apple has no obligation to provide maintenance or support for the
app, and, to the maximum extent permitted by law, has no warranty obligation
with respect to it. Apple and its subsidiaries are third-party beneficiaries of
these Terms and may enforce them against you.
